David S. Rubin, a partner in the firm’s Labor, Employments and Benefits practice group, published “New sick time act may not apply to union employees” in the December 2014 issue of New England In-House. The article discusses the new Earned Sick Time Act, which was approved by Massachusetts voters on November 4, and required private employers to provide sick leave to their employees. Labor unions were among the leading backers of the ballot question, however, there is a good chance that unionized workers will be the one segment of the Massachusetts workforce not covered by the Act, due to preemption.
